Claims can  arise if there has been a breach of the terms of the contract of employment.  A contract does not necessarily have to be written down – sometimes terms are implied by law.   Wrongful dismissal claims can arise for example if an employee has been given the wrong notice period.   There are important distinctions between wrongful dismissal claims and unfair dismissal claims which lead to different remedies.
